Kenyan High Court Suspends U.S.-Backed Ebola Quarantine Plan Amid Constitutional Challenge

A Kenyan High Court has temporarily halted a plan to establish a United States-linked Ebola quarantine facility in the country, suspending the arrangement until a constitutional challenge is heard on June 2, Prime Business Africa reports.

The ruling blocks Kenyan authorities from admitting or facilitating entry of any individuals exposed to or infected with Ebola under the proposed agreement with the United States, which had been designed as part of Washington’s containment strategy amid the worsening Ebola outbreak in eastern Democratic Republic of Congo (DRC).

The case was filed by the Katiba Institute, a Kenyan rights organisation, which accused the government of entering into the arrangement in a secretive manner without adequate public participation, parliamentary oversight, or constitutional transparency. The group argued that the plan raised serious concerns about the right to health, fair administrative action, and national biosecurity safeguards.

Court filings show that the proposed facility was intended to function as a 50-bed quarantine centre for U.S. nationals exposed to Ebola during the ongoing outbreak in eastern DRC. Under the arrangement, exposed individuals would reportedly be quarantined in Kenya before onward medical transfer where necessary, forming part of a broader U.S. effort to prevent importation of cases.

The plan, however, triggered significant domestic backlash in Kenya, including concerns from sections of the medical community and civil society groups who questioned both the transparency of the agreement and the country’s preparedness to host a high-risk infectious disease facility. Critics also warned that the arrangement could expose Kenya to unnecessary public health risks despite the country not recording any Ebola cases in the current outbreak.

According to Reuters, the United States had also committed funding toward Kenya’s Ebola preparedness capacity as part of the broader cooperation framework tied to the quarantine proposal.

The controversy comes as the World Health Organization continues to respond to a major Ebola outbreak in eastern DRC, which has spread across conflict-affected provinces and triggered regional concern after cases were detected in neighbouring Uganda.

The outbreak has been described by health authorities as one of the most complex in recent years due to insecurity, population displacement, and porous borders across the region.

Kenya’s High Court ruling effectively pauses implementation of the arrangement until the matter is fully heard, leaving the future of the proposed facility dependent on the outcome of the constitutional case scheduled for early June.
