El-Rufai Resists Attempted Arrest at Abuja Airport, Legal Team Condemns EFCC Actions

Former Kaduna State Governor Malam Nasir Ahmad El-Rufai resisted an attempted arrest by security operatives, reportedly linked to the Economic and Financial Crimes Commission (EFCC), upon his arrival at Nnamdi Azikiwe International Airport, Abuja, from Cairo, Egypt, Prime Business Africa reports.

Eyewitnesses and videos circulating online showed a brief confrontation between El-Rufai and the operatives, with supporters intervening as the former governor insisted on formal documentation before complying. El-Rufai reportedly told the operatives: “Nobody, not even the president, can tell me to do anything without a letter.”

El-Rufai’s legal team, led by Ubong Esop Akpan of The Chambers of Ubong Akpan, condemned the operation as unlawful, alleging that operatives attempted the arrest without a warrant or lawful directive and confiscated his international passport. The statement explained that the EFCC invitation that triggered the operation was delivered to El-Rufai’s residence while he was abroad, and that he had already communicated with the commission since December 2025, indicating his willingness to respond upon return. The former governor had notified the agency that he would appear at their office at 10:00 a.m. on Monday, February 16, 2026.

“Resorting to arrest despite this clear commitment exemplifies arbitrary conduct and undermines procedural integrity,” the legal statement said, noting that citizens present at the airport intervened, insisting that any arrest comply with constitutional procedures.

The lawyers further argued that the attempted arrest violated key constitutional rights, including:

  • Section 35 – Right to Personal Liberty
  • Section 36 – Right to Fair Hearing
  • Section 34 – Right to Dignity of the Human Person
  • Section 41 – Freedom of Movement
  • Section 44 – Right to Own Property

The legal team demanded the immediate cessation of all unlawful actions, the return of his passport, and a formal apology from the authorities. They also warned that legal action would be pursued to ensure accountability and uphold the rule of law.

As of press time, no response had been received from the EFCC or other security agencies regarding the allegations.

This incident comes amid heightened political tensions, with El-Rufai having recently shifted from the All Progressives Congress (APC) to the African Democratic Congress (ADC) and publicly criticized the current administration.
