Donald Trump Seeks Sentencing Delay in Hush Money Case

Former President Donald Trump, currently the Republican candidate for the 2024 presidential election, has requested that his sentencing in the New York hush money case be postponed until after the November election.

Trump’s legal team argued that sentencing him on September 18, just weeks before the election, could interfere with the electoral process.

Legal Team’s Argument for Delay

In a letter released on Thursday, Trump’s attorneys, Todd Blanche and Emil Bove, stated, “There’s no reason to continue rushing this process.”

They emphasised that a delay would allow Trump to consider his options following a ruling by Judge Juan M. Merchan on 16th September regarding whether to dismiss the case based on a U.S. Supreme Court decision about presidential immunity.

The attorneys also reiterated their concerns about potential conflicts of interest, noting that Judge Merchan’s daughter works as a Democratic political consultant, which they argue could affect the judge’s impartiality.

“By delaying the sentencing until after the election, the Court would lessen, if not remove, concerns about the fairness of any future proceedings,” the legal team stated.

Judge’s Role and Possible Outcomes

Judge Merchan has yet to rule on the request for a delay and has previously expressed confidence in his ability to remain impartial despite the concerns raised by Trump’s attorneys.

The Manhattan district attorney’s office, which brought the case against Trump, declined to comment on the matter.

The case involves Trump’s conviction in May for falsifying business records to conceal a 2016 payment to adult film actress, Stormy Daniels.

Prosecutors argued that this payment was made to prevent voters from learning about an alleged 2006 sexual encounter, a move they claim was part of a broader effort to shield damaging stories during Trump’s first presidential campaign.

Trump, however, denies all allegations and maintains that the payments were legitimate legal expenses.

Potential Implications of the Case

Falsifying business records is a serious offence in New York, carrying a possible sentence of up to four years in prison.

However, Trump could also face penalties such as probation, a fine, or a conditional discharge, which would require him to avoid further legal trouble to prevent additional punishment.

Trump’s legal team argues that the Supreme Court’s recent ruling on presidential immunity should have influenced the case, particularly concerning the evidence presented during the trial.

They believe that the jury should not have been shown testimony from former White House staffers about Trump’s response to media coverage of the Daniels payment.

The Path Forward

Trump, who is the first former U.S. president to be convicted of a crime, has vowed to appeal the verdict but cannot do so until after sentencing.

His attorneys have urged the court to provide sufficient time to explore all possible legal options following the 16th September ruling on immunity.

As the 5th November election day approaches, with early voting starting in many states before or around Trump’s scheduled sentencing, the court’s decision on whether to delay the sentencing could significantly impact the upcoming presidential race.
