Appeal Court Affirms Adeleke As Osun Gov, Sets Aside Tribunal Judgement

The Court of Appeal sitting in Abuja has today set aside the decision of the Osun State Governorship Election Tribunal and upheld the election of Senator Ademola Adeleke as the governor of the state.

A three-man panel of the court led by Justice Mohammed Shuaibu, in a unanimous judgment on Friday, quashed the tribunal’s ruling and gave its verdict to uphold Adeleke as the authentic governor of Osun State.

Recall that the Osun tribunal had held that Adeleke did not score the majority of lawful votes during the July 16, 2022, governorship election, and ordered that his Certificate of Return be withdrawn from him and issued to Adegboyega Oyetola of the All Progressives Congress (APC).

However, the Appeal Court Panel today overruled the tribunal’s ruling.

The panel upheld the issue of BVAS raised against Oyetola, stating that the Osun State tribunal was wrong to have said that there was overvoting, a claim that only relied on the evidence by Oyetola and the APC, and as such, doesn’t prove their case in any way.

The Appeal Court Panel, therefore, reinstalled Adeleke as the elected governor of Osun State.
