U.S. Announces Visa Restrictions over South Africa Race, Land Policies

The United States on Tuesday announced new visa restrictions on foreign nationals it says are responsible for or complicit in race-based discrimination, incitement of imminent violence and policies enabling land seizures without compensation in South Africa.

Secretary of State Marco Rubio said the measures target people involved in enacting or implementing such policies, escalating tensions between Washington and Pretoria over South Africa’s land-reform programme and the treatment of minority groups.

The restrictions will be imposed under Section 212(a)(3)(C) of the U.S. Immigration and Nationality Act, which allows the secretary of state to deem a foreign national inadmissible if their entry could have potentially serious adverse consequences for U.S. foreign policy. Certain family members may also be covered.

The announcement follows President Donald Trump’s executive order addressing what his administration described as “egregious actions” by South Africa. Washington has accused Pretoria of failing to adequately address concerns over discrimination against Afrikaners and other minority groups, as well as land expropriation without compensation.

Rubio also cited concerns over racially motivated crime and chants and slogans that Washington says could incite racial violence.

South Africa has rejected allegations that its land-reform policies amount to racial persecution, saying the measures seek to address inequalities created by colonialism and apartheid.

The State Department did not identify individuals who would be affected by the restrictions. Rubio urged the South African government to address Washington’s concerns, saying the conduct at issue undermines peace, economic stability and the rule of law.
