NBA Condemns Alleged Courtroom Incident, Says No Judge Can Order Lawyer to Kneel

The Nigerian Bar Association has condemned an alleged courtroom incident at the Federal High Court in Abuja, where a judge reportedly ordered a lawyer to kneel during proceedings, describing the development as inconsistent with established judicial standards.

In a statement issued by NBA President, Afam Osigwe on Tuesday, the association said the incident occurred on Monday, March 16, 2026, and involved Mohammed Umar and legal practitioner Marshall Abubakar, who appeared as lead defence counsel to activist Omoyele Sowore.

According to the NBA, the trial judge directed the lawyer to step out of the Bar and kneel after he raised his voice while addressing the court over the suitability of a hearing date. The judge was also said to have threatened committal proceedings for contempt.

The association said it viewed the development with “utmost seriousness,” citing its implications for the dignity of the legal profession and the sanctity of the courtroom.

While acknowledging that judges are empowered to maintain order and discipline in court, the NBA stressed that such authority must be exercised strictly within the bounds of the law and established procedures.

It noted that although courts have the power to punish for contempt, that power is circumscribed by defined legal processes designed to ensure fairness, objectivity and respect for the rights of all parties.

The NBA maintained that directing a legal practitioner or any Lawyer to kneel in court is not a recognised judicial sanction under Nigerian law and does not align with expected standards of judicial conduct.

It added that the dignity of the court must be preserved not only in its decisions but also in the manner judicial authority is exercised, emphasising that due process must be followed where contempt is alleged.

The association also reminded legal practitioners of their duty to conduct themselves with restraint, professionalism and respect for the court, noting that while lawyers are entitled to advocate firmly on behalf of their clients, such advocacy must remain within the bounds of decorum.

It stressed that the relationship between the Bar and the Bench is fundamental to the administration of justice and must be guided by mutual respect.

The NBA called for calm and restraint, urging that any grievances arising from courtroom incidents be addressed through appropriate institutional and disciplinary mechanisms. It added that it would engage relevant authorities where necessary to ensure that the rule of law and judicial ethics are upheld.
