Supreme Court To Decide Nnamdi Kanu's Fate On December 15

The fate of Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), will be decided by the Supreme Court on December 15.

This date follows a series of legal battles and a prior order by the Court of Appeal in Abuja, delivered on October 13, 2022, which called for Kanu’s release and quashed the terrorism charges filed against him by the Federal Government.

In the Court of Appeal’s unanimous decision, a three-member panel ruled in favour of Kanu, a verdict that the Federal Government was not content with, leading them to appeal to the highest judicial authority in the land.

During the recent proceedings, a five-member panel at the Supreme Court, headed by Justice Kudirat Kekere-Ekun, scheduled the matter for judgment after both parties presented their final briefs.

Kanu’s lead counsel, Mike Ozehkome (SAN), used the opportunity to appeal not only for Kanu’s immediate release but also for a substantial punitive cost to be levied against the government.

He passionately stated, “We urge My Lords to uphold our cross-appeal and do substantial justice to this matter in favour of the respondent who has been in detention since June 29, 2021, even after the lower court ordered his release. My Lords should also order that he should never be prosecuted again on the same counts.”

Ozekhome further emphasized that Kanu’s continued detention was unconstitutional and implored the Supreme Court to deliver justice, reinforcing the principle that no individual or government should be above the law.

On the opposing side, the Federal Government’s lawyer, Tijani Ghazali (SAN), implored the apex court to overturn the Court of Appeal’s judgment, which ordered Kanu’s release.

Ghazali also sought the court’s intervention in resuming Kanu’s trial before the Federal High Court in Abuja on terrorism-related charges.
