Yahaya Bello: Court Dismisses Bail Application In N110bn Fraud

A recent ruling by the Federal Capital Territory (FCT) High Court has dismissed the bail application of Yahaya Bello, former governor of Kogi State, in an ongoing fraud case.

The case centres around an alleged N110 billion scam, with charges filed by the Economic and Financial Crimes Commission (EFCC).

Court Rejects Yahaya Bello’s Bail Request

The bail application, filed on November 22, was rejected by Justice Maryann Anenih on the grounds that it was submitted before Bello was officially taken into custody by the EFCC.

Bello was detained on November 26 and subsequently arraigned on November 27. Justice Anenih deemed the bail request premature, as it was filed before the proper legal process had been initiated.

Premature Bail Application

Justice Anenih explained that a bail application typically challenges the detention of a defendant, and since Bello had not yet been arrested when the application was filed, it was deemed invalid.

The judge pointed out that the motion essentially sought to influence the court’s jurisdiction before the defendant was officially in custody.

Charges Against Yahaya Bello

On November 27, Bello, along with co-defendants Umar Shuaibu Oricha and Abdulsalam Hudu, was formally charged in court.

The EFCC brought a 16-count charge, which includes allegations of criminal breach of trust, involving the sum of N110,446,470,089, among other accusations.

These charges have been brought on behalf of the federal government, and the case is marked FCT/HC/CR/778/24.

Legal Process Moving Forward

The dismissal of Bello’s bail application highlights the importance of adhering to the correct legal procedures in cases of this nature. The court’s decision signals that any future bail applications must follow established processes. The trial is expected to continue in the coming weeks, as the case progresses.

The ruling also sets the stage for further scrutiny of the alleged fraud, with many looking on to see how the case will unfold.
